Under the Regulations councils provide permits to: 

  • construct
  • install
  • alter an onsite wastewater management system of up to 5000 litres a day. 

If you want to install or construct a new system or alter an existing one, you must apply for a permit from your local council. Councils can refuse a permit if the system doesn’t meet our specifications.

The Regulations put clear obligations on those who manage or are in control of land where an onsite wastewater management system is located.
The Regulations also introduce new duties for the operation and maintenance of an onsite wastewater management system. This includes a duty to: 

  • keep maintenance records
  • respond to problems
  • notify council of system failures.

The Regulations also set offences and allow councils to order system maintenance and enforce breaches of duties.

These Regulations apply to all onsite wastewater management system, including older systems installed before installation permits were introduced.
