- Background of offence
The accused, between 19 and 22 May 2023, deposited industrial waste, being construction and demolition waste, by burning it on his property in Parwan (Charge 1).
On 26 May 2023, the EPA issued an Environmental Action Notice (EAN) to the accused requiring him to immediately cease burning waste at the premises.
On 3 August 2023, EPA officers attended the premises and observed a burning pile of construction and demolition waste (Charge 2).
The accused contravened the EAN by burning waste on 3 August 2023 (Charge 3).
