- Background of offence
- Ryan’s Family Hotel Pty Ltd operated an entertainment venue in Traralgon. From 18th November 2021, EPA received a high volume of community complaints regarding unreasonable and prolonged periods of amplified music from the venue. EPA Officers attended the premise and observed the premises operating DJ music in an outdoor marque.
EPA issued a Prohibition Notice prohibiting the engagement of any activity which would cause the emission of unreasonable noise during night-time periods. Unreasonable noise continued to be emitted following this notice. Ryan’s Family Hotel further failed to implement reasonably practicable measures to limit noise, constituting a breach of the General Environmental Duty. - Date of court hearing
