- Background of offence
Renex Op Co Pty Ltd operates a thermal waste treatment facility in Dandenong South. The
premises was a scheduled premises as defined in the Environment Protection (Scheduled
Premises and Exemptions) Regulations 2017. The scheduled category was A01 Prescribed Industrial
Waste.
On 30 Jule 2016, Renex was granted a licence under the Environment Protection Act 1970 (the Act)
allowing it to accept, store and treat prescribed industrial waste (PIW) (including contaminated
soil and thermal recovery of hydrocarbons) at the premises. The PIW was treated via a combustion
process resulting in a substance referred to as thermally treated material (TTM).
Between 24 June and 30 June 2021, Renex engaged Kingston Plant Hire Pty Ltd to transport
2978.54 tonnes of TTM from Renex's premises to a quarry in Woodside.
The quarry did not hold a permission or authority of any kind granted by the EPA to receive a
deposit of thermally treated material or any other type of industrial waste as contained within the
meaning of the Act.
On 1 July 2021, EPA officers attended the quarry following a report from a member of the public.The officers observed black soil-like material in an area approximately 60m long x 60m wide. The
material contained pieces of plastic, wood, ceramic, concrete and rebar within the material. The
surface area of the black material was 2450.17m2.
Samples were taken of the material and analysis indicated the levels of PFOS, PFHxS and PFOA
exceeded the limits/criteria for reuse of the TTM as set out in Renex's licence.
Renex were issued with an Environmental Action Notice on 25 October 2021 to clean up the
material. By 24 June 2022, the EAN had been complied with. Testing undertaken by Renex
confirmed there was no contamination of the quarry.- Date of court hearing
