Refuse / Failed to comply with requirements of Information Gathering Notices (IGNs) in the State of Victoria on 24 June 2022, contrary to s.255(2).
- Background of offence
Between 1 January 2022 and 30 April 2022, the offender registered 73 demolitions with the Victorian Building Authority.
EPA conducted a check of EPA Waste Tracker and found of the 73 Demolitions, only 19 had any Waste Transport Certificates, all of which involved asbestos. Of the 19 Certificates, only 13 were recorded as depositing the asbestos waste at a licensed site. EPA therefore suspected that asbestos was stored illegally.
As a result of this information, Information Gathering Notices were served on the offender, to identify the nature of any and all asbestos identification and handling at each demolition. Each IGN related to an individual demolition and requested information relating to the asbestos register, asbestos identification, movement and disposal.
EPA received no communications from the offender in relation to compliance.
