1. Failed to comply with Environmental Action Notice (EAN) at Echuca on 05 January 2022, contrary to s.290(1).

Background of offence

Echuca Productions Pty Ltd and its director Christopher Peat operate an abattoir located in Echuca. Part of their licence conditions states that “offensive odours must not be discharged beyond the boundaries of the premises”. There have been 67 pollution reports EPA has received since April 2019 relating to offensive odour.

An inspection was conducted 26 October 2021 and an offensive odour was detected and so an IGN was issued. A further inspection was conducted 09 November 2021 and EPA observed bunding that was substandard and unsealed ground in the bunding as well as the Murray river approximately 60m away from the tank. An EAN was then issued.

On 13 January 2022 a further inspection was conducted which revealed that the EAN had not been actioned.
