Court orders made

Convicted on two charges, fined $5,000 on charge 1 and $10,000 on charge 2 (total fines $15,000), both stayed to 1 May 2006, and ordered pursuant to s.67AC:

1. To carry out a specified project as detailed below for the public benefit by paying the total sum of $45,000 by instalments as follows:
(a) $15,000 on or before 1 September 2005;
(b) $15,000 on or before 1 December 2005; and
(c) $15,000 on or before 1 February 2006;
to the Moonee Ponds Creek Co-ordination Committee Incorporated.
2. The Defendant must provide the Informant with proof of the payment within 14 days after each payment is due pursuant to this Order.
3. The payment must be solely used for the purpose of undertaking the Jacana Wetlands Revegetation Project.
4. The Defendant is prohibited from referring to this payment without reference to these proceedings.
5. Pursuant to s.67AC(2)(a) of the Act, the Defendant is ordered to publicise the offences, their consequences and the penalty and Orders imposed by this Court by publishing a notice in relation to these proceedings.
6. This notice must:
(a) be in the wording specified in clause 8 of this Order and must not be supplemented by additional text;
(b) be published in the Early General News section of the Hume Leader;
(c) be published within 30 days of the date of this Order;
(d) be of a minimum size of 12cm by 3 columns and all of the text be of a font size at least 10 point;
(e) contain the Defendant’s corporate logo.
7. The Defendant must provide the Informant with a copy of each publicised notice within 14 days of the date of that notice appearing.
