EPA can grant an exemption to a class of persons from a requirement in the Regulations or other subordinate legislation.
EPA can only do so if the exemption:
- will not pose a serious risk of harm to human health or the environment, and
- it is not practicable for the person to comply with the requirement or the exemption is needed to efficiently administer the law.
An exemption is only effective if the conditions of the exemption are complied with.
