Court orders made

Convicted and fined $750 on each charge (total fines $1500) and ordered pursuant to s.64 of the Act to remove tyres from the unlicensed premises, as follows.

The order relates to premises occupied by the offender and located at Lot 4, 902 Inglewood-Rheola Road, Kingower, Victoria (“the premises”).
The order takes effect immediately and expires on Friday, 1 May 2009.

The offender must

(1) ensure that:
    (a)  no used tyres are brought onto the premises;
    (b)  no used tyres are burned or buried at the premises;
    (c) by 30 April 2009 all used tyres on the premises:
(i) are taken from the premises to premises that are licensed
     pursuant to section 20 of the Act to receive such waste; or
(ii) are taken from the premises and reused or disposed of in
     accordance with EPA publication 1107 dated March 2007,
     titled “Correct disposal and reuse options for used tyres”; 
     and
 
(2) keep a record of all used tyres taken from the premises showing:
    (a) the date on which any tyres are removed;
(b) the number of tyres removed on each such date;
(c) for each removed load of tyres, the name and licensed premises address of the licence holder receiving that load;
(d) for each removal load of tyres not taken to a licensed premise, the intended use of that load of tyres; and

(3)  ensure that any authorized officer of the Environment Protection Authority who asks to do so can, by way of supervision, inspect:
(a) the premises, as part of a 2-monthly schedule of visits commencing Wednesday, 20 August 2008 and continuing until all used tyres are removed from the premises but also including any final or near final inspections required; and
    (b)  the record detailed in (2) above.
