With conviction, ordered pursuant to s.67AC of the Act as follows:

  1. Pursuant to s.67AC(2)(c) of the Environment Protection Act 1970 (“the Act”), MOBIL REFINING AUSTRALIA PTY LTD (“the Defendant”) is ordered to carry out three specified projects as detailed below for the public benefit by paying the following amounts, totalling $350,000, within 30 days of the date of this Court Order:
  2. Project No 1: Payment to Amount

    • Williamstown High School $210,000
    • Melbourne Water Corporation $110,000 (Waterwatch program)
    • Jawbone Marine Sanctuary Care Group Inc  $30,000

    The payment of $210,000 to Williamstown High School must solely be used by the School for the purpose of undertaking the following project: Project 1: Jawbone Marine Sanctuary Stormwater Recycling Wetlands

    This project relates to creating a wetland which will reduce and intercept stormwater inputs into the Jawbone Marine Sanctuary with interactive / educational trails. The payment of $110,000 to Melbourne Water Corporation (Waterwatch) must solely be used by Melbourne Water for the purpose of undertaking the following project:

    Project 2: Drain Spotters

    This project establishes, trains and equips 4 Drain Spotter Teams to provide on-the-ground resources to monitor, detect and report pollution events around drains. The project is part of the Waterwatch program which engages community and local industry in raising awareness of the protection of local waterways. The payment of $30,000 to Jawbone Marine Sanctuary Care Group Inc. (“Jawbone”) must solely be used by Jawbone for the purpose of undertaking the following project:

    Project 3: Jawbone Marine Sanctuary Enhancement

    This project establishes an ecological monitoring program in Jawbone Marine Sanctuary using the Sea Search and Reefwatch community monitoring programs and also provides interpretive signs for the Sanctuary. Within 14 days of making each payment the Defendant must provide the Informant with proof  there of. The Defendant is prohibited from referring to any of the payments or projects without referring to these proceedings. Pursuant to section 67AC(2)(a) of the Act, the Defendant is ordered to publicise the offence, its environmental or other consequences and any penalty imposed or orders made by this Court by publishing a notice about these proceedings.

    The notice must contain the Defendant’s corporate logo and be:
  3. in the wording specified in paragraph 12 below and not supplemented by additional text
  4. of a minimum size of 12 cm by 3 columns
  5. surrounded by a continuous black border
  6. published within 21 days of the date of this Order (or within such time as is reasonably practicable given the intervening Christmas, New Year period) in the Editorial section or the front part of the Early General News section of the following newspapers:
    • The Mail
    • The Maribyrnong Leader
    • The Age
    • The Herald Sun, and
    • The Australian Financial Review.
  7. The notice must also be displayed in the “news room” section of the Defendant’s website for a period of 30 days.
  8. Pursuant to section 67AC(2)(b) of the Act, the Defendant is ordered to notify its shareholders of the offence, its consequences and the penalty and orders imposed by this Court by publishing in its 2008/2009 Annual Report the paragraph 7 notice as specified in paragraph 8(a) – (c).
